1. Introduction and Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“You” or “User”), and The Crewsaide, concerning your access to and use of the www.thecrewsaide.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). We are registered in Minnesota. You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Membership and Account Registration
To access certain features of the Site, including the member directory, you may be required to register for an account. You agree to keep your password confidential and will be responsible for all use of your account and password. You must be at least 18 years of age to register and use the services provided by this Site.

3. Payments and Subscription
If you purchase a membership or subscription, you agree to the pricing, payment, and billing policies. All payments shall be in U.S. Dollars. We reserve the right to change our prices at any time. We will provide you with reasonable advance notice of any price changes.

4. User-Generated Content
The Site allows you to post content, such as your profile, skill tags, portfolio links, and other creative work (collectively, “User-Generated Content” or “UGC”).

• • Ownership: You retain all ownership rights to your UGC.

• • License to Us: By posting UGC, you grant The Crewsaide a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute your UGC on the Site for the purpose of promoting you and the platform.

• • Accuracy and Representation: You represent and warrant that all UGC is original to you and does not infringe on the intellectual property or other rights of any third party.

• • Prohibited Content: You agree not to post any UGC that is illegal, defamatory, obscene, or violates the intellectual property rights of others.

5. Directory and Collaboration
The member directory is provided to facilitate collaboration and networking among filmmakers. While we strive to provide a positive and respectful environment, we are not responsible for the outcomes of any collaborations or interactions initiated through our Site. Users are responsible for vetting and entering into agreements with their collaborators.

6. Site Management
We reserve the right, but not the obligation, to:

• • Monitor the Site for violations of these Terms.

• • Take appropriate legal action against anyone who violates these Terms.

• • Refuse, restrict access to, or disable (to the extent technologically feasible) any User-Generated Content or any portion thereof.

• • Manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

7. Intellectual Property
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein are owned or controlled by us. The Content is provided on the Site “AS IS” for your information and personal use only.

8. Limitation of Liability
In no event will The Crewsaide or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages.

9. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your use of the Site or breach of these Terms.

10. Governing Law
These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of Minnesota applicable to agreements made and to be entirely performed within Minnesota, without regard to its conflict of law principles.

11. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion. We also reserve the right to modify or discontinue all or part of the Site without notice at any time.

12. Right to Terminate
We reserve the right, in our sole discretion, to suspend or terminate your account and/or your access to and use of the Site, at any time and for any reason, without notice. This includes, but is not limited to, if you violate these Terms or if we determine, in our sole discretion, that you have engaged in conduct that is inappropriate or that threatens the rights or safety of others or the proper functioning of the Site. Upon termination, your right to use the Site will immediately cease.

Privacy Policy for The Crewsaide

The Crewsaide (“we,” “us,” or “our”) is committed to protecting the privacy of the Minnesota filmmaking community. This Privacy Policy explains how we collect, use, and safeguard your information when you visit http://thecrewsaide.com. 

1. WHO WE ARE

Our website address is: http://thecrewsaide.com. The Crewsaide is operated by Alison Guessou. For privacy-related inquiries, contact us at: hello@thecrewsaide.com. 

2. INFORMATION WE COLLECT AND WHY

Comments
When visitors leave comments on the site, we collect the data shown in the comments form, as well as the visitor’s IP address and browser user agent string to assist with spam detection. 

An anonymized string created from your email address (a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: automattic.com. After approval of your comment, your profile picture is visible to the public in the context of your comment. 

Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website. 

User Profiles
For users that register on our website, we store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information. 

3. COOKIES 

Comments
If you leave a comment, you may opt-in to saving your name, email address, and website in cookies for your convenience. These last for one year. 

Login
If you visit our login page, we set a temporary cookie to determine if your browser accepts cookies (contains no personal data; discarded when you close your browser). When you log in, we set cookies to save your login info (2 days) and screen display choices (1 year). If you select “Remember Me,” your login persists for two weeks.

Editing
If you edit or publish an article, a cookie indicating the post ID is saved (contains no personal data; expires after 1 day). 

4. EMBEDDED CONTENT FROM OTHER WEBSITES

Articles on this site may include embedded content (e.g., videos, images, articles). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that content.

5. YOUR RIGHTS UNDER THE MINNESOTA CONSUMER DATA PRIVACY ACT (MCDPA)

As a platform serving Minnesota, we recognize your rights regarding your personal data:

• Right to Access & Portability: You can request a copy of the personal data we hold about you in a portable format.
• Right to Correction: You can request that we fix inaccurate or incomplete personal data.
• Right to Deletion: You can request that we delete your personal data, subject to legal obligations (e.g., administrative or security purposes).
• Right to Opt-Out: You have the right to opt-out of the sale of personal data or targeted advertising. Note: The Crewsaide does not sell your personal data to third parties.
• Right to List of Third Parties: You may request a list of specific third parties to whom we have disclosed your personal data.

6. DATA RETENTION & SHARING

Retention
If you leave a comment, the comment and its metadata are retained indefinitely. For registered users, we store profile data as long as the account exists.

Sharing
If you request a password reset, your IP address will be included in the reset email.

Spam Detection
Visitor comments may be checked through an automated spam detection service. 

7. DATA SECURITY 

We implement reasonable security measures to protect your information. However, no electronic transmission over the internet can be guaranteed to be 100% secure.
